A.  Fulton County Center for Regional Growth: Ron Peters

DISCUSSION: Ron Peters stated that it has been a busy month for the Fulton County Center for Regional Growth.  He advised that he presented the Tryon Technology Park recently to another Real Estate broker.

V. OLD BUSINESS:

A.  Proposed Pioneer Window Project:

  1. Status Report:
  • Still waiting to close on project.

B. Swany Project:

  • The closing on terminating the IDA’s lease with Swany is scheduled for December 18, 2018.

VI. NEW BUSINESS:

A.  Invoices for Legal Services:

  1. General Services:
  • Invoice received from Fitzgerald, Morris, Baker, Firth for providing general legal services to the IDA in 2018.
  • Total Invoice: $6,129.00

IDA ACTION:

MOTION:       To authorize a payment in the amount of $6,129.00 to Fitzgerald, Morris, Baker, Firth.

2.  Regional Business Park Annexation:

  • Invoice received from Fitzgerald, Morris, Baker, Firth for legal services rendered in 2018 on Regional Business Park annexation.
  • Total Invoice: $175.50

IDA ACTION:

MOTION:       To authorize a payment in the amount of $175.50 to Fitzgerald, Morris, Baker, Firth.

3.  Swany Project:

  • Invoice received from Fitzgerald, Morris, Baker, Firth for legal services provided as part of Swany’s request to terminate its lease with the IDA.
  • Total Invoice: $2,000
  • Swany will be reimbursing the IDA for this invoice.

MOTION:       To authorize a payment in the amount of $2,000 to Fitzgerald, Morris, Baker, Firth.

B. NYS Economic Development Council:

  • IDA has received the annual membership invoice from the NYS Economic Development Council.
  • Total Invoice: $750
  • These funds are included in IDA’s 2018 Budget.

MOTION:       To authorize a payment in the amount of $750 to the NYS Economic Development Council.

VII. OTHER BUSINESS:

A.  Executive Session:

  1. Upon a majority vote of its total membership, taken in an open meeting pursuant to a motion identifying the general area or areas of the subject or subjects to be considered, a public body may conduct an executive session for the below enumerated purposes only, provided, however, that no action by formal vote shall be taken to appropriate public moneys:
          1. matters which will imperil the public safety if disclosed;
          2. any matter which may disclose the identity of a law enforcement agent or informer;
          3. information relating to current or future investigation or prosecution of a criminal offense which would imperil effective law enforcement if disclosed;
          4. discussions regarding proposed, pending or current litigation;
          5. collective negotiations pursuant to article fourteen of the civil service law;
          6. the medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation;
          7. the preparation, grading or administration of examinations;
          8. the proposed acquisition, sale or lease of real property or the proposed acquisition of securities, or sale or exchange of securities held by such public body, but only when publicity would substantially affect the value thereof.
